REACH is the new EU chemicals regulation which has entered into force on June 1, 2007. It is a system for the Registration, Evaluation, Authorization and Restriction of Chemicals. Not only manufacturers located in the EU are affected by the chemicals regulation. Manufacturers outside the EU must also come to terms with REACH if they want to market their products to the EU.

Manufacturers outside the EU in principal have the possibility of having their substances from non-EU countries registered with the European Chemicals agency (ECHA) by their own agent (company) within the EU by importers or by an Only Representative (Article 8). Registration through importers, however, has certain disadvantages!  For example:

  • Several importers:  Considerable effort is required for coordination and communication between the non-EU manufacturer and the importers.
  • A single importer (sole importer):  All customers in the EU are restricted to one single supplier in order to purchase the manufacturer’s product.
  • Confidential data are passed on within the manufacturer’s own supply chain
